Xen Habits Terms of Service

These Terms govern your access to and use of “Xen Habits” provided by Curious Crafts SAS.

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree, do not create an account or use the App.

You must be at least [16] years old (or the minimum legal age in your country) to create an account.
If you are under the required age, you may use the App offline only without transmitting personal data.

• Provide accurate, current information.
• Keep your login credentials secure.
• You are responsible for all activity under your account.

We grant you a personal, non-exclusive, revocable, non-transferable, limited license to install and use the App on devices you own or control, solely for personal, non-commercial purposes.

• Billing: Subscriptions renew automatically unless cancelled at least 24 h before the end of the current period.
• Platform rules: Payments are processed by Apple / Google. Their terms and refund policies apply.
• Trial periods: If you cancel during a free trial, you will not be charged.

Habit logs, reminders, analytics, and any insights provided are for informational purposes only and do not constitute medical advice. Consult a qualified professional for health or psychological guidance.

You retain ownership of the data you enter. By uploading or syncing content, you grant us a world-wide, royalty-free license to store, back-up, display, and process that content solely to operate and improve the App.

You agree not to:

1. Violate any law or regulation.
2. Reverse-engineer, decompile, or tamper with the App.
3. Transmit malware, automated scripts, or excessive requests.
4. Harvest personal data from other users.

We may suspend or terminate accounts that breach these rules.

All logos, code, and content (excluding your data) are our or our licensors’ property protected by copyright, trademark, and other laws. No rights are granted except as expressly stated.

The App may link to Firebase, Apple HealthKit, Google Fit, etc. Your use of those services is governed by their terms; we are not responsible for their content or practices.

You may delete your account in-app or by emailing privacy@curiouscrafts.com.co.
We may terminate or suspend access immediately, with or without notice, for any breach.
Upon termination, your license ends and data will be deleted within [30] days, except where we must retain it for legal reasons.

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind—express or implied—including fitness for a particular purpose, non-infringement, or uninterrupted availability.

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms will not exceed (a) the amount you paid us in the 12 months before the claim or (b) USD 100, whichever is greater.

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of your misuse of the App or violation of these Terms.

These Terms are governed by the laws of the Republic of Colombia, excluding its conflict-of-law rules.
Any dispute shall be resolved in the courts of Cartagena, Colombia unless §16 (Arbitration) applies.

We may update these Terms. Material changes will be notified in-app or by e-mail at least 7 days before they take effect. Continued use after that date constitutes acceptance.

If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
